Attorney Miller on Trump

I'm about to say what many people don't want to hear. However, Legal logic is Legal logic.

Although I disagree with Donald Trump on a lot of things, I definitely agree with him on using his Fifth Amendment protection to not say a word, because surely he would incriminate himself. I know of no absolute immunity given to him, if he had said something indicating criminal wrongdoing.

Secondly, you should never place an ex President under oath and be able to ask him questions that may threaten confidential information that could threaten the welfare of our country. Presidents are different from anyone else, because they know things that only a President should be privileged. No matter how anxious to get to truth, you should never burn down the house, trying to get a rat.

Another thing is, a President or ex President must never go to prison. It presents a national risk. Just by being a President, you are already somewhat in prison for life. The government must keep a steady hand on you and your whereabouts, because you know too much. You can't even go to prison, unless you are in solitary confinement, where you can't tell confidential secrets and things to other incarcerated criminals. And, if a President is placed in solitary confinement for the rest of his life, that would amount to cruel and unusual punishment, when compared with others punished by the law for similar criminal conduct.

If you know that someone is questioning you, hoping you will admit to criminal wrongdoing and you know you may sound like a crook, it makes good sense to use the Fifth Amendment, perhaps unless you are promised absolute immunity against prosecution for what you say.
